For the most complex cases, large volumes of records can be overwhelming. There is however a strategy that can make all the difference: pre-approved pagination. This approach not only eases the burden on legal teams but can also lead to cost reductions and more efficient proceedings.

In “Re X, Y and Z [2010] All ER (D) 229” paragraph 141 offers invaluable guidance. It recommends the recovery of pre-approved pagination costs, particularly in cases involving complex investigations, such as fabricated or induced illness. The reason behind this guidance is clear:

  • Streamlined Record Management: The burden of responsibility on legal teams to read, mark and digest large sets of records can be immense. Pre-approved pagination ensures that these records are not just organised but also indexed, making them easily navigable for all parties involved.
  • Cost-Efficiency: Investing in pagination can lead to cost savings in other areas. For instance, it can result in a reduction in the fees of medical experts. By having records collated, paginated and indexed, legal professionals and the court can efficiently access and present evidence, ultimately streamlining proceedings.
